In criminal law, culpability, or being culpable, is a measure of the degree to which an agent, such as a person, can be held morally or legally responsible for action and inaction. It has been noted that the word culpability "ordinarily has normative force, for in nonlegal English, a person is culpable only if he is justly to blame for his conduct". The guilt principle requires that in order to convict a person it is necessary to ascertain his voluntary or reckless behaviour, Strict Liability being prohibited.

En droit pénal français, la culpabilité est l'état d'une personne qui a adopté le comportement décrit par un texte d'incrimination. La culpabilité est déclarée par un juge qui doit vérifier la réalisation de trois conditions: * Il faut premièrement qu'il y ait un lien de causalité entre le comportement et l'incrimination. * Il faut également que l'intérêt protégé par la loi ait été mis en péril. Ainsi le bourreau n'était pas condamné pour meurtre car la vie du condamné à mort n'est plus un intérêt protégé par la loi. * Il faut enfin qu'il soit prouvé que le comportement reproché est bien celui de l'accusé.
