erfloze nalatenschap

It serves to ensure that property is not left in "limbo" without recognized ownership. It originally applied to a number of situations where a legal interest in land was destroyed by operation of law, so that the ownership of the land reverted to the immediately superior feudal lord.

Een erfloze nalatenschap (Frans: la succession en déshérence) is een nalatenschap zonder erfgenamen of algemene legatarissen, hetzij omdat er geen bestaan, hetzij omdat ze niet gekend zijn, hetzij omdat ze de nalatenschap hebben geweigerd. Erfloze nalatenschappen komen toe aan de Staat. Wordt de nalatenschap evenmin door de Staat opgeëist, dan spreekt men van een onbeheerde nalatenschap.
