The owner of the property, who grants the lien, is referred to as the lienee and the person who has the benefit of the lien is referred to as the lienor or lien holder.

El derecho de retención es aquel que asiste a un determinado sujeto para que pueda prorrogar la posesión sobre una cosa, con finalidad de garantía. En España el referente más claro y didáctico del derecho de retención se halla relacionado con la prenda y se reconoce en el art. 1866 del Código Civil.
