Een testament is een hoogstpersoonlijk, niet openbaar document waarin iemand schriftelijk vastlegt, of door een notaris laat vastleggen, wat er na zijn/haar dood met zijn/haar nalatenschap moet gebeuren in afwijking van de algemene wettelijke bepalingen. Het werkt pas na overlijden en mag alleen dan openbaar worden gemaakt aan mensen die daar een rechtstreeks belang bij hebben (art. 4:42 BW). Het testament kan zelf geschreven worden, een onderhandse akte die in bewaring moet worden gegeven bij een notaris, maar meestal worden de wensen, officieel uiterste wil of wilsbeschikking, door een notaris vastgelegd in een notariële akte. In Nederland werden in 2021 ruim 370.000 testamenten geregistreerd bij het Centraal Testamenten register. Het woord testament is ontleend aan Latijn testāmentum, dat uit testāri ‘getuige zijn’ wordt afgeleid.
